Welcome to Pathfinders Psychology and Consulting, LLC. These Terms and Conditions ("Terms") govern your use of our website and online consulting services.
By accessing our website or engaging our services, you ("Client," "you," or "your") agree to be bound by these Terms.

1. Services Provided
Nature of Services
We provide psychological and mental health consulting services on an hourly basis through various digital platforms including:

Video calls and virtual meetings

Phone consultations
-
Email correspondence and written advice
Not a Crisis Service, Supervision, or Therapy

In consulting, the consultant provides recommendations, but the clinician retains full responsibility for clinical decisions. In supervision, the supervisor typically shares legal/ethical responsibility for client care and can direct the supervisee's actions.

If a clinical consultant begins addressing the consultee's personal psychological issues, the relationship has crossed into therapy territory. This creates ethical problems because the roles are incompatible, consultation should remain focused on professional practice, not personal treatment.

2. Professional Relationship
The services we provide constitute consulting and educational guidance. Depending on your location and our credentials, our relationship may or may not constitute a formal therapeutic or clinical relationship. We will clarify the nature of our professional relationship during our initial consultation.
3. Eligibility and Responsibilities
1. Age Requirement
You must be at least 18 years of age to use our services independently. Minors may only access services with parental or legal guardian consent and participation.

2. Accurate Information
You agree to provide accurate, current, and complete information during registration and throughout our professional relationship.

3. Cooperation
Effective consulting requires your active participation. You agree to:

Attend scheduled sessions on time

Communicate openly and honestly

Complete any agreed-upon tasks or exercises

Inform us of any changes in your circumstances that may affect our work together.
4. Scheduling and Appointments
1. Booking
Appointments can be scheduled through our online booking system or by contacting us directly. All appointments are subject to availability.

2. Cancellation Policy

24-Hour Notice Required: Cancellations or rescheduling requests must be made at least 24 hours before your scheduled appointment

Late Cancellations: Cancellations made with less than 24 hours notice will be charged 50% of the session fee
-
No-Shows: Failure to attend a scheduled session without prior notice will result in a charge of 100% of the session fee

Emergency Exceptions: We understand that true emergencies occur and will handle these on a case-by-case basis
3. Our Cancellations
If we need to cancel or reschedule an appointment, we will provide you with as much notice as possible and work with you to find an alternative time.

4. Fees and Payment
1. Hourly Rate
Our services are billed at an hourly rate of $175 per hour. Rates are subject to change with 30 days' written notice.

Payment is due at the time of booking the service unless alternative arrangements have been made in writing

We accept : Visa, Mastercard, AMEX, Discover, Apple Pay, Google Pay, PayPal, Jcb, Maestro, Debit Cards

All fees are in USD.
3. Partial Hours
Sessions or consultations lasting less than a full hour will be billed in 30-minute increments.
​4. Additional Services
Additional services such as report writing, correspondence with third parties, or extended email consultations will be billed at our standard hourly rate.
5. Non-Payment
Failure to pay for services may result in:

Suspension or termination of services

Collection actions

Reporting to credit agencies

Legal action to recover unpaid amounts
6. Refund Policy
Due to the nature of consulting services, refunds are generally not available once a session has been completed. Refunds for prepaid services may be considered on a case-by-case basis.

6. Technology and Communication
1. Platform Requirements
You are responsible for ensuring you have:

A reliable internet connection

Compatible device (computer, tablet, or smartphone)

A private, quiet space for sessions
2. Technical Issues
In the event of technical difficulties:

We will attempt to reconnect or switch to an alternative communication method

If a session cannot be completed due to technical issues on our end, you will not be charged

If technical issues are on your end, standard session fees apply
3. Communication Between Sessions

Email communication is for scheduling and brief questions only

Extensive email consultations will be billed at our standard hourly rate

We typically respond to non-urgent emails within 48 business hours
-
Email is not appropriate for urgent matters or crisis situations
4. Recording
Neither party may record sessions (audio or video) without the express written consent of the other party.
7. Intellectual Property
1. Our Materials
All content provided by us, including but not limited to worksheets, assessments, written materials, and recommendations, remains our intellectual property and is provided for your personal use only.
2. Restrictions
You may not:

Reproduce, distribute, or share our materials without permission

Use our materials for commercial purposes

Modify or create derivative works from our materials
8. Limitations and Disclaimers
1. No Guarantees
While we strive to provide high-quality consulting services, we cannot guarantee specific outcomes or results. Mental health and psychological well-being are influenced by many factors beyond our control.
2. Professional Judgment
Our recommendations and advice are based on our professional judgment and the information you provide. You are ultimately responsible for your own decisions and actions.
3. Not Medical Advice
Unless we are specifically licensed to do so, our services do not constitute medical advice or treatment. If you require medication management or medical intervention, we will refer you to appropriate medical professionals.
4. Jurisdictional Limitations
Our services are provided in accordance with the laws and regulations of Florida. We may not be licensed to provide services in all jurisdictions.
9. Liability and Indemnification
1. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services.

Our total liability for any claims arising from our services shall not exceed the amount paid by you for services during the six months preceding the claim.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

10. Termination
1. Your Right to Terminate
You may terminate our professional relationship at any time by providing written notice. You will be responsible for payment for services rendered up to the termination date.

We reserve the right to terminate our professional relationship if:

You fail to pay for services

We determine that we cannot provide effective services to you

Continuing the relationship would pose an ethical conflict

You engage in threatening, abusive, or inappropriate behavior
​11. Professional Ethics and Boundaries
1. Dual Relationships
We maintain professional boundaries and avoid dual relationships that could impair our professional judgment or create conflicts of interest.

2. Appropriate Conduct
Both parties agree to maintain appropriate professional conduct. Inappropriate behavior, including but not limited to harassment, threats, or romantic advances, may result in immediate termination of services.
12. Dispute Resolution
1. Informal Resolution
If you have a concern or complaint about our services, we encourage you to contact us first so we can attempt to resolve the matter informally.

2. Mediation
If informal resolution is unsuccessful, both parties agree to attempt mediation before pursuing legal action.
3. Governing Law
These Terms shall be governed by the laws of Florida, without regard to conflict of law principles.
4. Jurisdiction
Any legal action related to these Terms must be brought in the courts of Florida.
13. General Provisions
1. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our services.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
3. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
